These Terms of Use (“Terms”) govern your access to and use of the DxTx website and the calculators, clinical tools, and related content available on it (together, the “Service”), operated by Orakle LLC, 1317 Edgewater Dr, #2367 Orlando, Florida 32804, United States (“Orakle”, “we”, “us”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Who the Service is for
The Service is intended for use by healthcare professionals and by students and researchers in healthcare fields. It provides access to published clinical scores, equations, and decision aids in an interactive format, for educational and informational purposes at the point of care. The Service is not intended for use by patients or the general public as a substitute for professional care.
2. Medical disclaimer. The Service does not provide medical advice, diagnosis, or treatment, and its use does not create a clinician–patient relationship with Orakle. Calculator outputs are estimates derived from published models applied to the values you enter; they describe groups of similar patients, not what will happen to any individual. Results must never be relied upon as the sole basis for a clinical decision. You remain solely responsible for all clinical judgements and for verifying any result against the original published source, which is cited on each calculator page. In an emergency, contact your local emergency services.
3. Accuracy and sources
We take care to implement each score or equation faithfully to its cited publication, and each calculator page identifies its source reference(s). However, published models have limitations, may be updated or superseded, and may not apply to your patient or setting. We do not warrant that any calculator is error-free, current, or suitable for any particular purpose.
4. Accounts and profiles
Creating a profile is optional. Profile details you enter (such as your name, country, occupation, specialty, and email address) and your favorites are stored only in your own browser on your own device; they are not transmitted to or held on our servers. Logging out, or clearing your browser’s site data, removes them. You agree to provide accurate information and not to impersonate any person.
5. Acceptable use
- Do not use the Service in any way that violates applicable law or regulation.
- Do not attempt to interfere with, disrupt, or gain unauthorised access to the Service or the systems hosting it.
- Do not scrape, reproduce, or redistribute the Service or substantial parts of it, other than outputs generated in the course of your own professional use (for example, copying a result summary into a clinical note).
- Do not remove or obscure attributions, citations, or legal notices.
6. Intellectual property
The Service, including its design, text, and software, is owned by Orakle or its licensors and is protected by copyright and other laws. The underlying clinical scores and equations are the work of their respective authors and publishers, as cited on each calculator page; nothing in these Terms claims ownership of those published works. We grant you a limited, revocable, non-exclusive licence to use the Service for the purposes described in Section 1.
7. Third-party services and links
The Service may reference or link to third-party content and services, including cited publications. We are not responsible for third-party content or services, and a link or citation does not imply endorsement.
8. Continuing education
Where a calculator is marked as CME-eligible, eligibility, accreditation, and any credit claiming are subject to the terms of the relevant accrediting body and may change without notice.
9. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the maximum extent permitted by law, Orakle and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of, or inability to use, the Service — including any clinical decision made or not made in connection with a calculator result. To the extent liability cannot be excluded, our total aggregate liability shall not exceed one hundred US dollars (US$100). Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
11. Indemnity
You agree to indemnify and hold Orakle harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.
12. Changes to the Service and to these Terms
We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time; the “Last updated” date above reflects the current version, and continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, and any dispute shall be brought in the state or federal courts located in Orange County, Florida, unless applicable law in your place of residence requires otherwise.
